Terms of Service

1. Definitions

• Scribeer: The service provider, based in Veenendaal, Netherlands, registered with the Chamber of Commerce under number 99771470.
• User: The natural person or legal entity using the services of Scribeer.
• Service: Converting audio and video files to text using AI technology.

2. Usage and Account

To use Scribeer, the User must create an account. The User is responsible for keeping login credentials confidential. A subscription is strictly personal (unless otherwise stated, such as with the Teams package) and may not be shared with third parties.

Improper use, including sharing login credentials or simultaneous use of one account by multiple persons outside the permitted tier, is not allowed. Scribeer reserves the right to immediately terminate service and access to the account upon detection of misuse, without right to refund.

It is prohibited to upload material that infringes on copyrights, is illegal, or contains harmful software.

3. Service Delivery and Results (AI Disclaimer)

Scribeer provides a best-effort obligation, not a result obligation.

The quality of transcription strongly depends on audio quality, background noise, and accents.

Private Mode (WebGPU)

For using Private Mode, the User is responsible for having adequate hardware (modern GPU, minimum 8GB RAM) and a compatible browser (Chrome/Edge). Scribeer does not guarantee that Private Mode works on outdated equipment or mobile devices. The User acknowledges that processing time when using Private Mode is entirely dependent on the specifications and computing power of their own hardware.

4. Payments and Credits

• Payments are processed securely through our partner Stripe.
• Credits are added to the account immediately after payment and are valid indefinitely as long as the account is active.
• Subscriptions (Private Pro/Teams) are billed monthly and can be cancelled at any time. Access to Private Mode expires at the end of the billing period after cancellation.
• Cloud subscriptions (Cloud Business / Cloud Enterprise) provide a monthly bundle of cloud transcription minutes for teams. Minutes reset at the start of each billing period; unused minutes expire and are not carried over. Cloud Business offers 1,000 minutes/month for up to 5 users (€29.99/month excl. VAT). Cloud Enterprise offers 2,000 minutes/month for up to 15 users (€59.99/month excl. VAT). Both subscriptions include access to the team dashboard.
• Given the digital nature of the service and immediate delivery, refunds for used credits are not possible.

5. Privacy and Data

Scribeer processes data in accordance with GDPR. For a detailed overview, please refer to our Privacy Policy.

• Audio files are only processed to generate the transcription and are deleted according to our privacy policy.
• Scribeer does not sell usage data and never uses it to train its own AI models. For external AI services, data is not used for model training according to their API policy. When the user enables a service with their own API key, the policy and configuration of that provider account apply.

6. Liability

• Scribeer is not liable for indirect damages, lost profits, or loss of data.
• Scribeer's maximum liability is limited to the amount the User paid for the Service in the three months preceding the damage event.

7. Intellectual Property

• The User remains the full owner of uploaded audio and resulting transcriptions.
• Scribeer retains all rights to the software, brand name, and application interface.

8. Applicable Law

These terms are governed by Dutch law. Disputes will be submitted to the competent court in the district where Scribeer is located.

9. Data Processing Agreement

For processing activities where Scribeer acts as Processor (such as Cloud Mode and Private Mode with synchronization), our Data Processing Agreement (DPA) applies as an integral part of the service. In Private Mode without synchronization, Scribeer does not process personal data and the User remains responsible for local processing.
